Background
On January 10, 2005, Christin A. Gilbert, accompanied by her parents, went to Women’s Health Care Services at 5107 E. Kellogg in Wichita, Kansas, to obtain a late-term abortion. She was 28 weeks pregnant, having just entered her third trimester. Christin was a 19-year-old female with Down Syndrome. Dr. George Tiller owns Women’s Health Care Services.
After the procedure was begun, Ms. Gilbert was then taken to LaQuinta Inn, where she continued to be under the care, treatment and monitoring of Dr. George Tiller.
On January 12, 2005, Christin A. Gilbert was brought back to the clinic because she was suffering from complications. She was treated merely for dehydration. Apparently no infection was detected at that time and she was returned to the motel.
On January 13, 2005, Christin again was taken to 5107 E. Kellogg with worsening complications and with serious medical problems. After some delay, an ambulance was called to transport Christin A. Gilbert to Wesley Medical Center where she died later that day, suffering from advanced, massive infection.
When calling for the ambulance, the abortion clinic representative requested that the ambulance not use red light or siren in order to avoid attention.
According to the autopsy report released by the Sedgwick County, Kansas, Regional Forensic Science Center, Christin A. Gilbert’s official cause of death is listed as “Complications of therapeutic abortion”.
Alleged violation of Kansas Statutes:
KSA 21-3404 (a) (c). Involuntary manslaughter.Involuntary manslaughter is the unintentional killing of a human being committed:
(a) Recklessly; or
(c) during the commission of a lawful act in an unlawful manner.
KSA 21-3437 (3). Mistreatment of a dependent adult.
Mistreatment of a dependent adult is knowingly and intentionally committing one or more of the following acts:
(3) omitting or depriving treatment, goods or services by a caretaker or another person which are necessary to maintain physical or mental health of a dependent adult.
KSA 21-3402. (b) killing of a human being unintentionally but
recklessly under circumstances manifesting extreme indifference to the value of human life.
KSA 38-1522. Reporting of certain abuse or neglect of children; persons reporting; reports, made to whom; penalties for failure to report or interference with making of a report. Those providing the abortion did not take proper steps to report to the local authorities that a Down Syndrome female was pregnant due to a criminal assault.
KSA 65-6703. Abortion prohibited when fetus viable, exceptions; determination of age of fetus; determination of viability; reports; retention of medical records; viable, defined; criminal penalties.
Thus,
we allege that, after the abortion was initiated, proper medical monitoring of Christin’s condition (while in a Wichita motel) should have disclosed the infections and her general physical decline. These severe complications, the general apathy concerning the worsening condition of Christin A. Gilbert; and the attempted cover up of the critical nature of Christin’s condition (listen to the 911 call); demand that a thorough, complete, and independent investigation by a Grand Jury be initiated to discover any violations of Kansas law that may have led to the death of Christin A. Gilbert.
The signatories hereby request the District Court of Sedgwick County, Kansas, within 60 days after the filing of this petition, cause a grand jury to be summoned in the county to investigate alleged violations of the law in the death of Christin A. Gilbert on January 13, 2005, and such other duties as may be authorized by law.
