Wichita, KS - Operation Rescue has launched its newest radio ad drawing public attention to the legal cases against late-term abortionist George R. Tiller.

OR originally announced its plans for a media blitz to draw attention to Tiller’s legal woes in February, then launched the campaign in March with radio ads on several stations and hundreds of thousands of automated phone calls to Kansas households.

Tiller’s attorneys responded by filing a motion to have the grand jury currently investigating Tiller disregard the campaign. In a five-minute hearing, Judge Paul Buchanan rejected the motion.

The latest radio ad takes aim at the delays in producing evidence to the grand jury and in the prosecution of Tiller’s pending criminal case.

“We intend to keep the public eye focused on these cases so that justice is properly served,” said Operation Rescue President Troy Newman. “If the judges and politicians realize that the public has not forgotten, they are more likely to act swiftly and with integrity.”

Wichita, KS – Late-term abortionist George R. Tiller is spending a lot on lawyers these days, with cases in three different venues moving along at a glacial pace. These cases can be summarized in three words: delay, delay, delay.

Earlier this week, the Kansas Supreme Court finally ruled that subpoenas for evidence issued by a citizen-called grand jury in January can finally be honored, after four months of delays in an investigative process that is supposed to last just 90 days. With the clock ticking on the new July 8 deadline for the grand jury to complete its investigation, the Court placed a maze of complex hurdles on the process of redacting patient identifying information that could be used by Tiller’s high-priced legal team to terminally delay the production of evidence.

In another case, the Kansas State Board of Healing Arts notified Operation Rescue representatives last week that two complaints against Tiller and two of his hired abortionists are still pending. That may sound like good news until you realize that one complaint has languished on the desks of KSBHA bureaucrats since October, 2006, and the other for over seven months without any end in sight.

The complaints allege dangerous violations of the standard of care and illegal abortions on viable babies that Kansas enacted laws to protect. Even with the recent shakeup at the KSBHA, the clear and present danger to women and their pre-born babies, and the fact that Tiller has been charged with 19 criminal counts of violating the non-affiliated physician requirement for post-viability abortions – an issue raised in one of the complaints – delay continues to be the name of the game.

Speaking of the criminal complaint against Tiller, which was filed in June of last year by disgraced former Attorney General Paul Morrison, that case has suffered delays to the point of absurdity.

Once the criminal case landed in the courtroom of Judge Clark V. Owens, the progress of the prosecution came to a screeching halt. The trial date has been reset a number of times. Judge Owens heard Tiller’s motions to dismiss the charges based on his belief that the law under which he is charged in unconstitutional on November 2, 2007. (Tiller and his lawyers think most laws are unconstitutional these days, especially the ones Tiller likes to break.) At the same time, Owens heard arguments that Tiller should be allowed a jury of twelve, instead of the state mandated jury of six for misdemeanor cases. (Tiller and his lawyers also think abortionists should get special treatment that no other citizen would ever receive.)

Now, seven months and one more missed trial date later, Judge Owens has yet to rule on these two motions. Deputy Attorney Generals Veronica Dersch and Jerald Maag, now under the direction of pro-abortion Gov. Sebelius’ new lap dog Steve Six, have mentioned nary a word about the outrageous delay in bringing this case to trial. In fact, you would think that Tiller signed their paychecks, with the way this case is being managed, and that they were being paid by the hour, to boot!

It has been often said that justice delayed is justice denied. Every day these investigations and legal cases drag on is another day that women are placed at risk and innocent viable babies that should have legal protections under the law are illegally murdered. Yes, murdered. And the blood of those innocent babies and the women injured and killed by botched abortions that occur all too frequently at Tiller’s chop shop stains the hands of those who delay that justice. Because the state authorities from the governor down are complicit in what can only be described as a conspiracy to cover up criminal actions by Tiller, that blood stains the windy prairies of the entire state.

It is time for the delays, the pandering, and the political corruption that props up Tiller’s bloody business to come to an end. The grand jury must be given access to the evidence they require. The KSBHA must get off their “blessed assurances” and suspend Tiller’s medical license, and Judge Clark needs stop with his Rip Van Winkle impersonations and move the criminal case forward. The Attorney General’s office needs to stop playing politics and do its duty to prosecute. Justice must be done – and soon. Only then will the needless killing of innocent babies in the latest stages of pregnancy stop.

Supreme Court punts records issue back to District Court

Topeka, KS — The Kansas Supreme Court ruled against late-term abortionist George R. Tiller who had asked the Court to rule that a citizen’s called grand jury was unconstitutional and should be dismissed. Instead the Court found that such grand juries are indeed constitutional.

In the same opinion, the Court ruled that subpoenas issued by the grand jury in their investigation into illegal abortions done by Tiller and his associates should be further reviewed by the Sedgwick County District Court to insure that the subpoenas are not overly broad or harassing in nature.

The grand jury issued subpoenas to Tiller in January for 2,000 late-term abortion records, a request that was later reduced to 50 records randomly chosen for each of the last five years. The subpoenas specifically state that all patient identifying information should be redacted before being sent to the grand jury.

“While we are gratified that the Kansas Supreme Court has upheld the right of citizens to call for grand juries, we are concerned that the order to punt the subpoena question down to the lower courts could be a stall tactic,” said Operation Rescue President Troy Newman. “This decision leaves an open door for further mandamus actions by Tiller’s attorneys. They know if they stall long enough with their frivolous motions, the grand jury term will expire, and the evidence will not have to be produced. That is obstruction of justice, pure and simple.”

The grand jury was seated on January 8, 2008, for a term of three months. That term was extended by Judge Paul Buchanan, but will expire on July 8, 2008, with no further extensions available.

“It is our prayer that the District Court will act swiftly to get the necessary evidence into the hands of the grand jury so justice can be done,” said Newman.

Omaha, NE — Warren Buffett’s investment company, Berkshire Hathaway, held its annual stockholders meeting on Saturday, May 3, 2008. Known as the “sugar daddy” to the abortion industry, Warren Buffett is the largest financial contributor to abortion in the world. On hand to greet the over 30,000 in attendance were pro-life activists with Rescue The Heartland and Operation Rescue’s Truth Truck.

Glorifying the “god of money,” two sign trucks could be seen driving around with large photos of Buffett on both sides with trite slogans that read, “My advice: Invest in Yourself” and “What’s a Good Education Worth?” In order to counter this propaganda, Operation Rescue’s Truth Truck was on hand to follow the Buffett trucks and give onlookers an education as to Warren Buffett’s chief investment: baby murder.

Although most in attendance were die hard Buffett supporters who could care less about the lives of innocent pre-born children, there were a number of positive encounters. One man, for example, said he was a Catholic and had no idea of Buffett’s abortion philanthropy. He said he was going to sell his stock first thing Monday morning because of it.

Due to public pressure, on July 3, 2007, Berkshire Hathaway announced that it was ending all corporate charitable donations. However, through his Buffett Foundation, Buffett supports the most radical aspects of the population control movement such as providing $2 million to fund clinical trials of Mifepristone (RU-486). Buffett also provided $2 million to Family Health International for the distribution of quinacrine hydrochloride, a chemical that sterilizes a woman by burning her fallopian tubes. Quinacrine is illegal in the U.S., but is used, often coercively, in Vietnam, India, and other nations.

In the late 1990s, Buffett committed to a $20 million grant to International Projects Assistance Services (IPAS), which manufactures and distributes manual vacuum aspirators, used for performing abortions in the Third World.

Then in 2006, Warren Buffett and Bill Gates, two of the richest men in the world and both anti-life fanatics, joined forces to create “an unfathomably large organization” that would continue to work to limit the world’s population through birth control, abortion, and sterilization.

Topeka, KS – The Kansas State Board of Healing Arts has notified Cheryl Sullenger and Troy Newman in separate letters that complaints they filed against late-term abortionist George R. Tiller and his associates are progressing. The complaints request that the medical licenses of three abortionists be suspended.

Sullenger’s complaint, filed against Tiller and abortionist Ann Kristin Neuhaus in October, 2006, involves allegations that Tiller conducted illegal late-term abortions using Neuhaus as the second concurring physician required by law for post-viability abortions. Sullenger submitted evidence compiled though Operation Rescue investigations that indicated that Neuhaus and Tiller were financially associated, which is prohibited by law.

Tiller has since been charged with 19 criminal counts of violating the non-affiliated physician law. That case is still pending and tentatively set for trial on June 16, 2008.

Newman’s complaint against Tiller and California abortionist Shelley Sella was filed in October, 2007, and alleges that the coerced abortion of Michelle Armesto-Berge was done prior to obtaining proper consent and other violations of the standard of care. Newman filed the complaint on Armesto-Berge’s behalf at her request.

Armesto-Berge’s horrific late-term abortion experience was first made public when she testified last September before a joint legislative committee investigating illegal late-term abortions and the non-enforcement of Kansas abortion laws.

Abortionist Shelley Sella is a resident of Oakland, California, and is an employee of Tiller’s and flies to Kansas every third week to abort babies at his Wichita abortion mill. Abortions after 24 weeks gestation are illegal in California.

“We are cautiously optimistic that the cases against Tiller, Neuhaus, and Sella will now be given the attention they deserve,” said Newman. Two top members of the Kansas State Board of Healing Arts resigned last month in a shake up over the Board’s slowness to act and over apparent cover-ups.

“Up to this point, the Board has refused to act to protect women and viable babies from illegal abortions. The situation in Kansas is critical. The lives of viable babies that laws were enacted to protect remain in jeopardy,” said Newman. “We pray that these abortion complaints will get moved to the front burner where they belong, and that suspensions of licenses will be soon forthcoming in the interest of public safety.”

Topeka, KS – In a huge victory for the rule of law, this morning the Kansas Supreme Court unsealed a secret lawsuit filed by Planned Parenthood against District Attorney Phill Kline. Planned Parenthood was seeking to have the Court order Kline to return abortion records that are critical evidence in Kline’s prosecution of 107 criminal charges against the abortion giant.

Instead the Court rejected a letter from former Attorney General Paul Morrison “exonerating” Planned Parenthood, indicating that the records showed no criminal conduct by Planned Parenthood. Morrison then engaged in acts meant to force the evidence from Kline’s possession in order to cover up criminal activity on the part of Planned Parenthood, who had supported his election campaign.

“Every judge that has reviewed the evidence has ruled that there is probable cause to believe that crimes have been committed by Planned Parenthood,” said Operation Rescue President Troy Newman.

Oral arguments in the case are scheduled for June 12.

The abortion records were subpoenaed by Kline when he was attorney general. When still the attorney general, Kline received permission from Judge Richard Anderson to forward the records to the Johnson County District Attorney’s office, with the court’s full knowledge that Kline had been appointed to that post. Planned Parenthood secretly sued Kline to get the records back, a suit that was joined first by Morrison, and then by Attorney General Stephen Six after Morrison’s resignation due to a sex and corruption scandal.

“It is wrong that the subject of a criminal investigation should be allowed to misuse secret proceedings to harass a prosecutor with falsehoods and spurious personal attacks as Planned Parenthood has done,” said Newman. “Now that this case has been unsealed, we trust that the truth of Planned Parenthood’s wrongdoing and the obstructionist attitude of the Attorney General’s office will finally come out.”

“The mantra from the AG’s office has always been that the records must be returned in order to protect patient privacy, but that couldn’t be further from the truth. All patient identifying information was redacted long ago. One has to wonder about the integrity of the attorney general’s office that continues to promulgate such untrue statements,” said Newman.

“In the interest of justice, Kline’s evidence must be allowed to be seen in a court of law at the time of trial and let a judge and jury decide. That’s the American way,” said Newman.

Southfield, Michigan – Abortionist Alberto Hodari viewed the broken remains of babies he aborted as trash, and cavalierly tossed them in the dumpsters behind his abortion mills, where they were discovered earlier this year by members of the pro-life group Citizens for a Pro-Life Society, led by Dr. Monica Miller.

The discovery unleashed a firestorm of public outrage, but authorities to which the crime of illegal dumping of human remains was reported did nothing more that order Hodari to retrain his staff on the proper disposal of “biohazardous waste.”

Saturday, May 3, 2008, those babies whose lives were treated as worthless by the abortionist, the state, and even their own mothers, will have some measure of human dignity restored to them.

Citizens for a Pro-Life Society will conduct a funeral for the babies to be held at St. Gerald’s Church, 21300 Farmington Road, in Farmington, Michigan, at 10:30 AM on Saturday. The funeral will be followed by a private interment at Holy Sepulchre Cemetery in Southfield, Michigan.

“These babies, created in the image of God, were precious and valuable. Our society will be diminished because of their loss,” said Operation Rescue President Troy Newman. “We commend Dr. Monica Miller and her group for showing compassion and respect for these children by offering them a proper burial. May God have mercy on their souls and on ours for tolerating the shedding of innocent blood.”

While newspapers such as the Kansas City Star continue to question whether coerced abortions are widespread, those of us who actually deal with pregnant and post-abortive women understand that this problem has reached epidemic proportions.

“The most common statement I have heard in my 24 years of counseling abortion-minded women has been , ‘You don’t understand. I don’t have a choice,’” said Operation Rescue spokesperson Cheryl Sullenger. “There are so many women out there who do not want to abort their babies, but do so because they feel pressured or threatened by people in their lives to the extent that they do not believe they can resist. Abortion mills are all too happy to play on the fears of these vulnerable women because today, due to the shrinking demand for abortion, there is cut-throat competition for each abortion dollar.”

The artist who created the cartoon below has this to say on the subject of coerced abortions:

This cartoon highlights an often overlooked fact about the so-called right to choose: more often than not, vulnerable young women are coerced into abortion. Coercion, under the guise of compassion, is the primary strategy employed to sell us on killing children, as well as the infirm and elderly. Parents, friends, school counselors, self-styled religious leaders and others often pressure young mothers, with little or no regard for the lives at stake or the common good. To be certain, many of those counseling abortion are themselves victims, their priorities, their understanding of life and of good and evil having been twisted by the false prophets of narcissism and nihilism. Which is why we must endeavor, like St. Francis, to be instruments of peace: “Where there is hatred, let me sow love; where there is darkness, light; where there is despair, hope.”

Wichita, KS – Wichita, Kansas, is the home of the most notorious late-term abortionist in the world: George R. Tiller. He has openly admitted killing babies up until the day before delivery and boasts of more late-term killing experience of anyone outside Communist China.

Now you have an opportunity to make a powerful pro-life statement – starting right in Tiller’s hometown!

Operation Rescue is proud to endorse the Kansas Coalition For Life’s 2008 signature ad and invite you to sign it. This ad is scheduled to be published in the Wichita Eagle on Mother’s Day, 2008, and other publications throughout the year as the budget allows.

The ad makes the following bold declaration:

Every human being is created by God, and has an inherent right to life and liberty. Therefore, like William Wilberforce and those who signed the petition to stop the English Slave Trade 200 years ago, we the undersigned urge those in public office, or in any position of power and influence, to stop taxpayer funding of organizations that promote abortion, and to help build a world where all human life is treated with justice, dignity, and love.

This ad campaign is being led by KCFL’s Mark Gietzen, who is also one of Operation Rescue’s faithful Truth Truck drivers. We encourage you to look over the full ad text, sign your name, and give as generous of a donation to the KCFL ad effort as you can.
